Synopsis  
 

Altering business structures, varying contractual clauses, terminating employment or transferring employees from one office to another – workforce changes are inevitable in any global business.


But all employers must be careful to comply with employment and immigration law requirements, particularly when operating across different APAC countries. Is a group meeting sufficient to communicate contractual changes to your employees, or do you need to obtain consent or signatures? Do you need an employment or business visa? What rights do employees have following a transfer of their employment? And might strict termination rules in one country delay a global restructuring project?


Our international panel will explore the key legal and compliance issues that you need to be aware of when making these types of changes to your workforce. We will use a practical case study to bring the issues to life, and there will be plenty of opportunity for questions and discussion.


The panel will include speakers from some of the top employment and immigration law specialist firms in APAC and will cover Hong Kong, Malaysia, Korea, Singapore and China.

 
Speakers
 
 

Jonathan Yuen, Partner at Rajah & Tann Singapore LLP, is the Head of the contentious side of the Employment & Benefits Practice Group of the firm. He has extensive experience advising and representing clients in complex corporate disputes by employing interest-based negotiation strategies and rigorous litigation when required; he has argued successfully as Lead Counsel at the High Court and the Court of Appeal. 


The Legal 500 Asia Pacific (2016) describes him as “commercially-savvy” and clients say that he is “sharp, thorough and solution driven” and “generates solutions that are thoughtful, clear and achieve business objectives.” 

 
 

Desmond Wee, Partner at Rajah & Tann Singapore LLP, is the Head of the General Corporate Commercial Practice Group and the non-contentious side of the Employment & Benefits Practice Group of the firm.


Desmond has more than two decades of legal experience, having started practice as a commercial litigation lawyer in another leading Singapore based law firm and followed by his appointment as regional regional group legal counsel of a Hong Kong public-listed corporation with business interests in both public-listed and private corporations throughout Asia before joining Rajah & Tann Singapore in 2000. This uniqueness of experience has resulted in Desmond’s appreciation and dealings with issues from very different perspectives.

 
 

Yau Yee Ming, Partner at Christopher & Lee Ong, qualified and practised in Australia and Malaysia and has worked in Hong Kong.  He has a corporate and commercial practice with deep industry knowledge in telecommunications (having worked for Lucent Technologies in a regional commercial and strategy role), information technology (having been in-house counsel for Accenture in Hong Kong), logistics engineering (monorail and bus design and manufacture), oil and gas services (oil country tubular goods, machine shop, drilling waste management, tubular goods supply chain management) and retail businesses.


Yee Ming’s forte is managing complex negotiations, especially in a technical environment.  His clients value the commercial insights he brings from the 10 years that he spent in industry in various strategy, commercial and general management roles within multinational corporations.
